Terms of Service

1. User Agreement

By accessing or using FlashMind, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Account Creation and Management

To access certain features of FlashMind, you may be required to create an account. By registering, you agree to:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your access credentials
• Immediately notify FlashMind of any unauthorized use or suspected breach of your account

Login may be performed via credentials (email and password) or Google OAuth authentication. FlashMind reserves the right to suspend or cancel accounts that violate these Terms.

3. Services

FlashMind provides tools for audio recording, transcription, flashcard creation, and spaced repetition learning. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without notice.

The user commits to using the application responsibly and in compliance with applicable laws, refraining from:

• Using the application for illegal purposes or harmful to third parties
• Interfering with or compromising the proper functioning of the platform
• Reverse engineering, decompiling, modifying, or improperly exploiting the application software

Violation of these provisions may result in suspension or deletion of the user's account without right to refund.

4. Privacy and Data Protection

FlashMind is committed to protecting users' personal data. Data processing occurs in compliance with applicable legislation. For more information, the user should consult our Privacy Policy, available online. By using the application, the user consents to the collection, storage, and use of their data as described in the policy.

5. Subscription Plans and Billing

FlashMind offers free and paid plans, which provide access to specific features. By opting for a paid plan, the user agrees to:

• Make full payment of applicable fees
• Authorize recurring charges to the registered payment method until the subscription is canceled

Available Plans

• Basic Plan: 5 hours of audio per month and 15 cards per transcription
• Pro Plan: 15 hours of audio per month, 25 cards per transcription, and detailed summaries
• Advanced Plan: 50 hours of audio per month, 100 cards per transcription, and detailed transcription using the advanced AI model

Cancellation and Refunds

The user may cancel the subscription at any time through the application or the device's app store. Cancellation will result in the discontinuation of future charges. Refunds will only be granted in the following cases:

• Improper charges
• Verified technical problems that make service use unfeasible
• Cancellation request within the regret period as provided by the Consumer Protection Code (7 days after purchase for Brazilian consumers)

6. Account and Data Deletion

The user can request permanent deletion of their account and associated personal data through the official FlashMind website. After the request, the data will be removed from our servers within a maximum of 30 days, except for legally required retention cases. Deletion is irreversible and will result in the loss of all transcriptions, flashcards, and learning history linked to the account.

7. Disclaimer of Warranties

FlashMind is provided "as is" and "as available," without warranties that the service will be uninterrupted, error-free, or secure for all purposes. The use of the application is at the user's own risk, and results may vary according to various factors.

8. Limitation of Liability

FlashMind is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, FlashMind and its developers will not be responsible for:

• Direct, indirect, incidental, or consequential damages arising from the use or inability to use the application
• Loss of data, profits, reputation, or any financial losses related to the use of the service
• Any damages resulting from user acts or omissions that contravene these Terms

In cases of suspension or cancellation of the account for violation of these Terms, there will be no refund of amounts paid, and the user may be prevented from creating new accounts.

9. Intellectual Property

FlashMind and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Changes to Terms

FlashMind reserves the right to modify these Terms at any time by publishing the updated version in the application. Continued use of the service after the publication of changes will imply tacit acceptance of the new conditions. Periodic consultation of this document is recommended.

11. Termination

We may terminate or suspend your account and access to FlashMind immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.

12. Applicable Law and Jurisdiction

These Terms will be governed and interpreted in accordance with the laws of the Federative Republic of Brazil, especially Law No. 13,709/2018 (LGPD) and the Consumer Protection Code. To resolve any controversies arising from this instrument, the jurisdiction of the district of São Paulo is chosen, with express waiver of any other, however privileged it may be.
